Sociale rechtvaardigheid: een hersenschim?

welke mate kunnen mensen hun samenleving veranderen en hun lot in eigen handen nemen? | |
Sociale rechtvaardigheid: een superstitieEr bestaat volgens Hayek een principiële onverenigbaarheid tussen de notie ‘sociale of distributieve rechtvaardigheid’ en de principes van het nieuwe liberalisme. De orde van de markteconomie - de term waaraan steeds weer gerefeerd wordt - wordt grondig verstoord als je er het principe van wanorde dat ‘sociale rechtvaardigheid’ heet in binnenbrengt. Een opvatting als deze hangt samen met een hele maatschappijvisie. De moderne maatschappij is in Hayeks visie een Maatschappij van vrije mensen, A. Smiths Great Society, Karl Poppers Open Society. In tegenstelling met de tribale samenlevingen van vroeger hebben individuen en groepen in de moderne maatschappij geen gemeenschappelijke doeleinden meer, doeleinden die door de structuur van het geheel worden opgelegd. Dat stelt de individuen in staat vrij te oordelen en te beslissen over wat ze zelf willen. In vroegere samenlevingen werden de sociale verhoudingen, de zeden, de individuele moraal bepaald en gestructureerd door een gemeenschappelijke finaliteit. In tribale samenlevingen is die finaliteit zelfs van die aard, dat ze door de leden a.h.w. intuïtief aangevoeld wordt. Het maatschappelijk gedrag wordt geleid door een sterke emotionele betrokkenheid. Dat is niet meer mogelijk in een maatschappij van vrije mensen. Waar geen gemeenschappelijke finaliteit meer bestaat, wordt geen onmiddellijk verband meer gezien tussen een bepaald gedrag en de weerslag ervan op de hele groep of op dit of dat individu. De sociale relaties zijn zo complex geworden, dat je geen duidelijk zicht meer hebt op de gevolgen van een beslissing, ja, het wordt onmogelijk de oorzaak van een bepaalde daad of situatie nog in verband te brengen met de intentie of de verantwoordelijkheid van enige handelende instantie. In een kleinschalige samenleving kan men nog proberen aan te wijzen wie verantwoordelijk is voor een sociale wantoestand of onrecht en deze ter verantwoording roepen. In een moderne maatschappij is dat uitgesloten; wie het toch wil doen, geeft blijk van een archaïsche mentaliteit, leeft nog in een primitief ontwikkelingsstadium, waar men het nog mogelijk achtte de sociale werkelijkheid in één coherente visie onder te brengen. maatschappij die niet meer bestaat, bijgeloof dat uitgaat van de veronderstelling dat er in de sociale verscheidenheid ‘iemand’ aan het werk is, ‘iemand’ die men aansprakelijk kan stellen, zoals een naïeve mentaliteit zich op een God beroept tegen de zogenaamde onrechtvaardigheden van de natuur. | |
Een schadelijk bijgeloof‘Sociale rechtvaardigheid’ is een leeg begrip geworden. Wie het hanteren, weten niet waarover zij het hebben. Van twee dingen één: ofwel dromen zij van een maatschappij die niet meer bestaat, waar ieder individu vertrouwd was met de aard en de invloed van de handelingen van alle anderen, ofwel praten zij om niets te zeggen. Hoe kàn men immers nog te weten komen wat ‘sociaal rechtvaardig’ is, welke handelingen nodig zijn opdat hun gevolgen met zekerheid diegenen ten goede komen die wij de minst bedeelden achten? ‘Op internationaal niveau is het totale gebrek aan enig algemeen aanvaard referentiepunt, aan enig principe in functie waarvan “sociale rechtvaardigheid” bepaald zou kunnen worden, onmiddellijk evident’ (II, p. 90). Dat alleen al zou ons tot voorzichtigheid moeten manen. Maar het beroep op sociale rechtvaardigheid spiegelt ons voor dat wij, op grond van een mythische voorstelling van de maatschappij die zogezegd door een verantwoordelijke wil gedreven wordt, wél over zulke criteria beschikken en wél kunnen ingrijpen. Welnu, dat interventionisme verstoort en vernietigt het spel van de regels die de Grote Maatschappij in evenwicht houden. Voor een goed begrip van Hayeks kritiek is het nodig hier een duidelijk onderscheid te maken tussen wat hij ‘gedragsregels’ en wat hij ‘organisatieprincipes’ noemt (Vol. I, Rules and Order, hfst. 1 en 2). Heel zijn analyse berust op een sociaal evolutionisme: elke samenleving ontwikkelt zich via discontinue kleine wijzigingen in een complex samenspel van microscopische, onmerkbare aanpassingen. Deze permanente evolutie wordt op gang gehouden door de initiatieven van individuen en groepen, maar voltrekt zich onbewust. Als individuen en groepen een initiatief nemen, doen ze dat niet omdat hun een globale verandering voor ogen staat, maar gewoon omdat ze op een gegeven situatie willen reageren vanuit de belangen en noodwendigheden van het leven. Dit proces brengt een spontane orde van de maatschappij voort, die haar beslag vindt in een geheel van ‘gedrags- of spelregels’. voor iedereen gelijk, bepalen ze onder welke voorwaarden een handeling geoorloofd en mogelijk is of niet en doen ze ons, om het feit te compenseren dat wij nooit àlle elementen van een gegeven situatie kunnen kennen, een algemeen referentiekader aan de hand, waarbinnen we verder vrij blijven en zelf kunnen uitmaken wat we concreet willen. Het gevaar nu is groot dat we die ‘gedrags- of spelregels’ verwarren met ‘organisatie- of interventieprincipes’. Dan dreigen we het originele karakter van de Grote Maatschappij te miskennen. Deze heeft haar uiterste complexiteit slechts verworven doordat ze zich los gemaakt heeft van een maatschappijtype dat als een organisch geheel werd opgevat; ze heeft zich ontwikkeld tot een niet gehiërarchiseerde, niet door een gemeenschappelijk doel gefinaliseerde ‘spontane orde’. Deze orde dreigen we grondig te verstoren als we in de ‘gedragsregels’ organisatieprincipes, principes van een bewuste en gewilde interventie invoeren, die precies voorschrijven wie wat en hoe moet doen. Als we ‘sociale rechtvaardigheid’ als zo'n interventieprincipe hanteren, maken we ons aan die verwarring schuldig en verstoren we de spontane orde van de gedragsregels; we stellen er een andere, voluntaristische orde voor in de plaats, die ieders gedrag tot in de details wil regelen met het oog op een gemeenschappelijk doel. ‘Een dergelijk project maakt het onmogelijk dat de verschillende individuen nog op grond van eigen inzichten en voor eigen doeleinden handelen, terwijl dit toch het wezen van de vrijheid is; het verplicht hen te handelen, zoals de autoriteit voorschrijft, volgens haar inzichten en voor doeleinden die zij vaststelt’ (II, 86). | |
Een totalitaire mythe‘Gedragsregels’ en ‘interventieprincipes’ zijn even onverzoenlijk als b.v. de regels van twee verschillende spelen. Je kunt de nadelen van de voetbalregels niet opheffen door er die van het basketball aan toe te voegen; het gevolg zou totale subjectieve willekeur zijn. Het betere is ook hier de vijand van het goede. Om bepaalde echte of vermeende wanordelijkheden weg te ruimen, riskeert men de maatschappij in een proces te verwikkelen dat het principe van de vrijheid vervangt door het storende principe van de inmenging. Dit verstoort niet alleen de ‘spontane orde’, maar gaat bovendien gepaard met een voortschrijdende bureaucratisering en een steeds grotere uitbreiding van de politieke macht. mische agenten kennen, dat zij kunnen uitmaken wat dezen moeten doen, dat zij de concrete informatiemogelijkheden waarover de individuen beschikken (ten aanzien van investeringen, nieuwe dienstverleningen enz.) kunnen vervangen door de zogezegd betere informatie en oriëntatie die zij voor ogen hebben. ‘Interventie is altijd onrecht: ze oefent dwang uit op het individu (veelal ten bate van een derde) in omstandigheden waar anderen vrij uitgaan en voor doeleinden die niet de zijne zijn... de personen die zo'n specifieke dwang ondergaan worden verhinderd hun activiteiten aan te passen aan de door hen gekende omstandigheden, en zien zich verplicht doeleinden te dienen waaraan anderen niet onderworpen zijn en die slechts gerealiseerd zullen worden ten koste van onvoorzienbare gevolgen’ (II, 129). Bovendien maakt het interventionisme de samenleving tot één groot slagveld waarop de verschillende groepen en individuen hun eigen belangen gaan proberen op te dringen en te verdedigen. In plaats van de inderdaad riskante onderlinge competitie, die de bron is van algemene welvaart, komt nu de poging van iedereen om zijn profijt te trekken uit de gemeenschappelijke rijkdom. Van de weeromstuit wordt ook de democratie bedreigd: de meerderheid, in plaats van aan de wet onderworpen te zijn, verheft zichzelf tot opperste wet en legt haar verlangens op aan de gemeenschap als de opperste norm (vooral hfst. 12 en 16). Omdat de spelregels verstoord zijn, kunnen nog alleen de sociaal geprivilegieerden of de luidruchtigste schreeuwers hun belangen verdedigen. Het maximum aan ‘sociale rechtvaardigheid’ brengt een maximum aan onrecht voort: als enig mogelijke wet geldt opnieuw de wet van de pressiegroepen. Via het waanbeeld van een doelgericht organisch geheel, dat alle delen bepaalt en beheerst, knoopt het interventionisme opnieuw aan bij het tribalisme. Het socialisme is ‘a revival of those tribal sentiments’ (II, 134). Het is een filosofie die in de praktijk tot totalitarisme leidt, d.w.z. tot een steeds grotere greep van de politieke macht en de tirannie van de meerderheid. Zij ontwricht de Grote Maatschappij, doordat ze de conflicten en de rivaliteiten tussen de belangengroepen aanwakkert, de onderlinge competitie, bron van alle vernieuwing, verstikt en meteen ook de mogelijkheid van een progressieve verbetering van de welvaart voor iedereen. Verre van de rechtvaardigheid te bevorderen, ondermijnt ze de grondslagen zelf van de weergaloze ontwikkeling van de Maatschappij van Vrije Mensen.Ga naar voetnoot2 | |

Reële kwalen als aanknopingspuntHet zou een grove vergissing zijn Hayeks ideeënwereld te herleiden tot de hier besproken kritiek. Met die kritiek verbindt Hayek zelf positieve, concrete voorstellen op het vlak van de economie (een pleidooi voor de marktcompetitie, voor méér maatschappijen en vennootschappen) en van de politiek (hij schetst zelf in grote trekken een Constitutie...). Wat men ook moge denken van zijn nu eens ernstige, dan weer buitenissige voorstellen (de staat zou geen munt meer mogen slaan, iedereen zou vrij moeten zijn de munt te gebruiken die hij verkiest), men dient goed in te zien dat zijn kritiek steunt op een coherente sociale filosofie. Dààr dient het debat zich te situeren, want die filosofie bepaalt Hayeks kritiek op de ‘verdelende rechtvaardigheid’, die hij met de ‘sociale rechtvaardigheid’ identificeert. Welnu, die filosofie knoopt aan bij heel reële kwalen van onze samenlevingen, die wij hier onder drie hoofdingen kunnen onderbrengen. | |
Overtrokken beheersbaarheidWat Hayek in de eerste plaats betwist, met name in het eerste deel van zijn standaardwerk, is wat hij het constructivisme noemt, de idee dat de maatschappij een soort materie is die wij naar believen kunnen transformeren en modelleren. Het constructivisme betoogt ‘dat de menselijke instituties slechts menselijke doeleinden dienen indien zij bewust met het oog op die doeleinden ontworpen worden; vaak zelfs dat alleen al het bestaan van een instelling bewijst dat ze met een bepaalde bedoeling ingesteld is, en steeds dat wij de maatschappij en haar instituties zo opnieuw te modelleren hebben, dat al onze activiteiten volledig geleid worden door gemeenschappelijke doeleinden... Maar de opvatting dat wij alle heilzame instituties aan een bewust ontwerp te danken hebben en dat alleen zo'n ontwerp ze tot nuttige instituties gemaakt heeft en kàn maken - is grotendeels fout’ (II, p. 8-9). Hayek is niet de enige die gewezen heeft op de noodlottige gevolgen van die grote mythe van een maatschappij die men naar believen kan omvormen al naar gelang de utopische idealen die men aankleeft. Maar de kracht van zijn betoog dwingt ons in te gaan op de simpele maar vaak verzwegen vraag: wat bedoelt men eigenlijk wanneer men het heeft over ‘de maatschappij veranderen’? Over alle polemiek heen dwingt Hayek ons te vragen naar de natuur van het sociale, zijn structuren en eigen regelmechanismen: hij noopt tot een ontmaskering van de min of meer denkbeel- | |

dige schema's die men op dat gebied pleegt te hanteren zonder ze op hun waarde te toetsen. Alle simplisme is ook hier uit den boze, met name de bedrieglijke tegenstelling tussen de enen - de socialisten - die de maatschappij willen veranderen en de anderen - de liberalen - die hardnekkig zouden zweren bij het status quo. Hayek zelf is een overtuigd voorstander van een maatschappij-in-ontwikkeling en stelt dat de Open Maatschappij voortdurend evolueert. Meer nog, hij betoogt dat het juist de bewuste inmenging van de politiek is die, door onbegrip van de natuur van het sociale of in naam van een gebrekkig rechtvaardigheidsideaal, die evolutie blokkeert en de maatschappij doet verstarren onder de domper van de bureaucratie of het totalitarisme. Men doet er verkeerd aan, na een vluchtige lectuur van Hayeks compromisloze stellingname, de reële problemen die hij stelt uit de weg te gaan. Valt elk ontwerp van maatschappelijke verandering onder de veroordeling van het constructivisme? Bestaat er zoiets als een centrale instantie die voor die verandering instaat? Zijn er in het complexe geheel van de sociale verhoudingen toch niet enkele van een fundamenteler en meer doorslaggevende aard? In de mate waarin Hayeks theorie dergelijke vragen opnieuw opwerpt, dwingt hij ons een aantal krachteloze en ontmoedigende mythes los te laten voor een genuanceerder en klemmender benadering van de sociale werkelijkheid. | |
Overtrokken politieke machtHayeks hardnekkige veroordeling van elke vorm van staatsinmenging is slechts te begrijpen vanuit zijn grondige argwaan ten opzichte van de macht: ‘De effectieve beperking van de macht is het belangrijkste probleem van de maatschappelijke orde’. Dit verklaart zijn onverzettelijke wil om de staatsbureaucratieën te ontmantelen, de moderne staat zijn geprivilegieerde positie in de samenleving te ontnemen, de democratie te bevrijden van de willekeur van de meerderheden. Hij wil vooral een einde maken aan heel die machtsuitbreiding, die tenslotte berust op de intellectuele dwaling van een antropomorfische voorstelling van de maatschappij: de politieke macht zou de commandopost zijn die de maatschappij moet opbouwen en verenigen onder het gezag van één coherente wil. Ook al is Hayeks pleidooi voor een containment van de politieke macht ingegeven door betwistbare sociale opvattingen, dan nog dwingt hij ons tot de erkenning van het ‘inflatoire’ karakter van de heersende idee en praktijk van de politieke macht. waar de impulsen en energieën neerdalen over een vormeloze en ongeordende werkelijkheid. ‘De politiek onttronen’ (hoofdstuk 18) betekent niet ervan dromen dat ze geheel verdwijnt, maar wel dat men er de wezenlijk relationele natuur van leert inzien. De politieke macht is niet het enige bewustzijnsniveau van een samenleving: wie op dat niveau verkeert, heeft nog niet vanzelf een bijzondere en geprivilegieerde wetenschap omtrent het goed van de gemeenschap en het zijn niet vanzelf de beste coördinatoren van de activiteiten van het geheel die daar zitten. De (politieke) macht mag niet de pretentie hebben de andere kennis- en beslissingsniveaus te vervangen: het is niet zo dat de andere instanties (ondernemingen, regio's, verenigingen) alléén het trieste voorrecht zouden hebben van een slechts partiële visie op het geheel. Hayeks anarchiserende kritiek leert ons beter zien dat de macht geenszins boven het sociale zweeft, dat haar wezenlijke functie er niet in bestaat een blinde maatschappij voor te schrijven wat er moet gebeuren maar de maatschappij te helpen ont-dekken wat zij wil, uitgaande van de rijke verscheidenheid en de complexiteit vol tegenstellingen die in die maatschappij voorhanden zijn. Macht weet niet méér dan om het even wie: ze is slechts - of zou moeten zijn - de instantie met behulp waarvan een samenleving, met haar conflicten en haar onzekerheid over zichzelf, poogt te ontdekken wat zij kàn willen. | |
Overtrokken rationaliteitHayeks kritiek op de uitwassen van de democratie of het totalitaire gevaar en zijn ophemeling van de vrije marktcompetitie krijgen pas hun volle betekenis en gewicht in het licht van zijn nog fundamenteler filosofische houding ten aanzien van de menselijke kennis, die ten grondslag zou liggen aan het constructivisme: men méént te weten wat de natuur van de maatschappij is, welke wetten haar ontwikkeling beheersen, welke de behoeften en voorkeuren van het individu zijn. Hayeks liberalisme zet zich sterk af tegen het optimisme van de Verlichting en berust zelf op een rationalisme van het niet-weten. Het socialisme meent te weten waarin het goed van de maatschappij bestaat, en leidt daarvan een voluntaristische politiek van sociale verandering af. Hayeks liberalisme daarentegen gaat uit van het postulaat dat niemand het geheel vermag te overzien en elke kennis begrensd is; het individu vergaart zijn altijd partiële informatie vanuit zijn eigen standplaats in het geheel en moet derhalve riskante initiatieven nemen in een onmogelijk te overwinnen onzekerheid omtrent de gevolgen daarvan voor anderen. systeem. Het gaat zoals in een spel: waar een winnaar is, is ook een verliezer, maar de verliezer weet dat hij een vorige keer gewonnen heeft, een volgende keer misschien weer winnen kan. Wie de wetten van de markt hun onvolkomenheid en eventuele frustrerende gevolgen verwijt, is het slachtoffer van de mythe van de onbereikbare perfectie en droomt van een organische (totalitaire) maatschappij, waarin alle individuele wilsuitingen volmaakt op het geheel afgestemd zouden zijn. Hayeks rationalisme is dus alles behalve dat van een triomfantelijke, alles beheersende rede. Het is het rationalisme van een beperkte, concrete, voor zichzelf ondoorzichtige rede gevangen a.h.w. in een traditie die ze gekregen heeft en niet zelf bepaald, in de pedagogische regels van juist gedrag waarvan zij niet altijd de gegrondheid kan doorzien, in een sociale, economische en geografische situatie die zij nooit volledig beheerst. ‘Man is not and never will be the master of his fate: his very reason always progresses by leading him into the unknown and unforeseen where he learns new things’ (de laatste zin van het hele werk, door Hayek zelf onderstreept). Tegen het willekeurig constructivisme stelt Hayek dat de maatschappij evolueert dank zij menigvuldige invloeden die niemand als zodanig wil, volgens een systeem van subtiele aanpassingen zoals een organisme zich stapsgewijze aanpast aan het omgevend milieu. Het socialistisch constructivisme brengt verlamde en onbeweeglijke maatschappijen voort, waarin de wetenschappelijke en economische vooruitgang stagneert. De principes van de Grote Maatschappij daarentegen scheppen de voorwaarden van de voortdurende verandering van de maatschappij. Alleen een getemperd rationalisme geeft het individu opnieuw zin voor - en moed tot - risico: het waarborgt geen succes, maar neemt evenmin alle initiatief af ten behoeve van een zogenaamd verlichte algemene wil. | |
De blinde vlekken van een theorieIn sommige landen inspireren Hayeks theorieën nu reeds een aantal economische projecten. De kans zit erin dat dit eveneens bij ons zou kunnen gebeuren, al was het maar uit reactie tegen de toenemende staatsinmenging. Om die reden is een fundamenteel debat geboden. Met name een debat over het sluitstuk van Hayeks theorie, zijn kritiek van de sociale rechtvaardigheid. Deze kritiek is immers onlosmakelijk verbonden met zijn verwerping van het politieke interventionisme en zijn interpretatie van de maatschappij als een spontane orde. | |

We gaan hier niet verder in op sommige van Hayeks ergerlijke simplificaties: elk verzet tegen zijn theorieën is in zijn ogen blijkbaar niets anders dan een louter emotionele reactie of superstitie. Even arbitrair en simplistisch is de manier waarop hij alle vormen van socialisme vereenzelvigt met totalitarisme. En het schijnt hem helemaal niet te verontrusten dat een ‘maatschappij van vrije mensen’ en een relance van de vrije markteconomie kennelijk niet mogelijk zijn zonder een krachtig militair regime als het Chileense. Het wezenlijk zwakke punt in Hayeks theorie is zijn opvatting over het sociale wezen van de mens. Ondanks zijn bewondering voor - en erkende schatplichtigheid aan - de culturele antropologie, schijnt hij geen besef te hebben van de ongemene complexiteit van de maatschappelijke werkelijkheid. Zijn interpretatieschema's stammen overigens nu eens uit de biologie (de maatschappij als lichaam), dan weer uit de cybernetica (de maatschappij als informatiesysteem), of de fysica (de maatschappij als een evenwicht tussen krachten). Al die schema's zoeken de merkwaardige idee te bevestigen van een spontane, zichzelf regulerende orde. Tevergeefs zoekt men naar enige demonstratie of illustratie van een dergelijke orde: het uitentreuren herhalen van het thema moet de afwezigheid van enige argumentatie goedmaken. Het enige aanwijsbare fundament van de spontane orde schijnt uit de traditie te komen: door hun acties en reacties ontwikkelen en wijzigen de mensen gedragsregels die erkend en gevolgd worden omdat zij hun deugdelijkheid bewezen hebben. Maar Hayek schijnt niet te beseffen hoezeer het produkt van de traditie een uitermate bont geheel is, vol verscheidenheid en contradicties, bestaande uit gedragsregels, mythen, historische voorstellingen, vooroordelen waarin lang niet alle groepen of klassen zichzelf herkennen. Niets van dat alles heeft iets spontaans: het is het produkt van eeuwen, getekend door geschiedenis en collectieve voorstellingen. Niets van dat alles vertegenwoordigt een orde waarvan men het immanente regelmechanisme te respecteren zou hebben. Wat Hayek van die spontane orde zegt, spruit eerder voort uit een theoretische wens dan uit empirische waarneming van de concrete evolutie van ingewikkelde maatschappijen. Men zou heel veel moeite hebben om het door hem gepostuleerde mechanisme ook maar ergens aan het werk te vinden. Juist omdat die zeer verscheiden tradities en regels niet in een spontane orde resulteren, moet er in dat disparate geheel een orde van rechtvaardigheid aangebracht worden. schappij in elkaar tegengestelde groepen die zich achter hùn regels, hùn gewoonten en gebruiken verschansen... Omdat de maatschappijen, zoals ze ons door de traditie overgeleverd zijn, als zodanig niet volkomen geordend zijn, behoort het tot de roeping van de mens er een menselijke orde in aan te brengen. Natuurlijk moet daarbij rekening worden gehouden met de verworvenheden van de traditie: zelfs Marx kon zich geen verandering van de maatschappij voorstellen die niet zou steunen op de erfenis van het verleden. Maar de eigenlijke politieke taak van de gesocialiseerde mens bestaat erin een menselijke zin te geven aan wat hem overgeleverd is. Dat is de grondslag van de sociale rechtvaardigheid en de bestaansreden van de sociale en politieke actie. | |
Een politiek zonder moraalHayeks verwerping van de idee van verdelende rechtvaardigheid vloeit voort uit zijn mechanistische opvatting van maatschappij en politiek. Indien immers de maatschappelijke orde geregeld wordt door een delicaat mechanisme als dat van een horloge (een vaak door Hayek herhaalde vergelijking), dan kan elke overijlde ingreep inderdaad niets anders doen dan dit subtiele evenwicht verstoren. Dezelfde mechanistische zienswijze beheerst Hayeks visie op de politiek: deze hoeft slechts de regels van de spontane orde te doen respecteren en moet zichzelf elke storende inmenging ontzeggen. De politiek stelt zich garant voor het geregelde sociale leven en verdedigt het tegen de verstoringen van de regels die haar zelf ontgaan. Hayeks fantasma van de ‘spontane orde’ sluit aldus elke sociale of politieke actie voor (meer) rechtvaardigheid uit en reduceert de hele politiek tot een controle-apparaat dat moet waken over de goede werking van de regels van de spontane orde. Maar wie alle actie of invloed op de geschiedenis uitsluit, sluit meteen de moraal uit de politiek uit. En dan wordt de idee van sociale rechtvaardigheid vanzelf een loos begrip. De politiek hoeft zich dan niet in te laten met de al dan niet gegronde aspiraties en verlangens van de mensen, dat leidt alleen maar tot ‘moralisering’. Ze moet niet de smeltkroes zijn waarbinnen menselijke verwachtingen met elkaar in conflict geraken en elkaar kunnen verhelderen. Ze dient uitsluitend de regels van juist gedrag te respecteren zonder zich te bekreunen om bestaande morele opvattingen, verlangens en idealen. van de onverenigbaarheid tussen liberalisme en moraal (rechtvaardigheid) dan de theorie van Hayek. In werkelijkheid echter bestaat een dergelijke onverenigbaarheid tussen een maatschappij van vrije mensen en de verdelende rechtvaardigheid niet: Hayek construeert ze op grond van zijn imaginaire voorstelling van een spontane orde en zijn al even denkbeeldige opvatting van de verdelende rechtvaardigheid, die hij zonder meer identificeert met een toenemende staatsbureaucratie. Zijn onbegrip van de moraal (en dus ook de rechtvaardigheid) leidt ertoe dat hij in elke interventie ten bate van rechtvaardigheid een uitbreiding van de staatsmachinerie ziet. Terecht klaagt hij de tendens in onze samenlevingen aan die alleen van de staat de verdediging van belangen en de verzekering tegen risico's verwacht, maar dat wil niet zeggen dat verdelende rechtvaardigheid onvermijdelijk neerkomt op (nog meer) bureaucratie. Het is integendeel juist de rechtvaardigheidsidee die ons o.m. ook in staat stelt de onbillijke verstaatsing te kritiseren en te bedwingen. Het is dan ook verbazend, dat Hayek nergens in zijn werk de traditionele definitie van de rechtvaardigheid vermeldt: ieder het zijne geven. Misleid door zijn mechanistische visie op het recht, vereenzelvigt hij de verdelende rechtvaardigheid zonder meer met de vermenigvuldiging van autoritaire reglementen en de verlamming van het individuele initiatief. | |
Het geweld van de ‘spontane orde’Op één punt breekt Hayek met het klassieke liberalisme, dat samenhing met het utilitarisme: hij distantieert zich van elk optimistisch geloof. Zijn rationalisme van het niet-weten gaf ons al te verstaan dat er nooit enige min of meer spontane overeenstemming te verwachten is van een verzoening tussen de vele particuliere belangen en opties. Zelfs het marktmechanisme wordt door Hayek helemaal niet voorgesteld als een mirakeloplossing: men dient het eerder te vergelijken met de regels van een spel, dat winnaars en verliezers aanduidt volgens principes of toevalligheden die niets van doen hebben met morele verdiensten. Geen enkele beslissing kan ooit met zekerheid voorzien welke gevolgen ze voor anderen zal hebben. En op dat stramien van onoverkomelijke onwetendheid dient volgens Hayek een maatschappij van vrije mensen zich te ontplooien. Je zou verwachten dat hij ten minste in deze context enige plaats zou inruimen voor de conflicten en tegenstellingen als beslissende momenten van een maatschappelijk leven dat zoekt naar een moeizame overeenstemming over ge- | |

meenschappelijke doeleinden. Maar in een mechanisme van economische mededinging dat verloopt volgens de regels van een spontane orde, is daarvoor geen plaats: de competitie speelt zich af binnen de vastliggende regels, ze stelt die regels zelf niet ter discussie. Hoe getemperd en bescheiden Hayeks rationalisme ook lijkt, het getuigt alles bij elkaar nog van een naïef optimisme. Alles verloopt alsof mensen geen belangen te verdedigen hadden, geen waarden aankleefden waarvoor zij willen leven en strijden. Alsof de mens in de eerste plaats een economisch wezen was, en niet een wezen gedreven door moreel verlangen, op zoek naar beter leven en naar zin. Die miskenning van 's mensen diepste wezen is de uiteindelijke verklaring van Hayeks miskenning van het geweld. Zijn mechanistisch schema ignoreert volkomen het feit en de analyse van 's mensen verlangen om goed te leven, om een waardevol bestaan te leiden, en om derhalve, waar het nodig is, voor (meer) rechtvaardigheid in het geweer te komen. Als de kunst van de sociale rechtvaardigheid er uitsluitend in zou bestaan de gevestigde spelregels te doen respecteren, zoals een scheidsrechter op een sportveld, dan is het helemaal niet meer te begrijpen waarom mensen toch zoveel moeite hebben om het eens te worden over de ordening van hun gemeenschapsleven. Die moeilijkheid spruit juist voort uit het feit dat mensen het niet over abstracte regels moeten zien eens te worden, maar over waarden van samen-leven als rechtvaardigheid, vrijheid, vrede... en daaromtrent bestaan de grondigste meningsverschillen. De tragische grootheid van het maatschappelijk leven is juist dat individuen en groepen slechts enige (overigens nog betrekkelijke) eenstemmigheid over die waarden kunnen bereiken in en door discussie en strijd. En dat fundeert nog eens de sociale rechtvaardigheid als een noodzakelijke onderneming, een nooit voltooide en ook riskante onderneming, omdat het verlangen om eens en voorgoed die rechtvaardigheid te vestigen inderdaad kàn leiden tot barbaars totalitarisme, daarin heeft Hayek gelijk. Noodzakelijk blijft ze echter, omdat er in de mens oneindig meer is dan het verlangen om het eens te worden over abstracte regels: het verlangen om door de ander erkend te worden in zijn eigen waardigheid. Paradoxalerwijze is juist dat verlangen tegelijk de bron van de meest ongenadige conflicten. Een liberalisme dat als antwoord op het menselijk zoeken naar zin niets anders te bieden heeft dan een oproep tot respect voor de abstracte regels van de sociale orde, maakt bitter weinig kans om gehoord te worden.

tiek als de instantie die alleen maar voor het respect van die orde moet zorgen, de mens zelf als een wezen dat al tevreden is als het in het maatschappelijk spel een plaats krijgt en initiatief kan ontplooien. Hayeks evolutionistisch liberalisme hangt samen met een antropologie die het morele verlangen en het daarmee verbonden geweld ignoreert. Het is blind voor zijn eigen theoretische en praktische gewelddadigheid, kortom voor zijn fundamentele onrechtvaardigheid. Het is dan ook niet zo verwonderlijk dat het, waar het door een militair regime wordt doorgedrukt, niet een spontane orde maar een onmenselijke chaos voortbrengtGa naar voetnoot3. |
