ForumOrgaantransplantaties: een kwestie van aangepaste wetgeving?Net voor het einde van 1982 heeft de Belgische ministerraad het wetsontwerp aanvaard over het wegnemen en overplanten van organen en weefsels. De staatssecretaris voor Volksgezondheid en Leefmilieu, F. Aerts, die het ontwerp voorbereidde, verklaarde dat hij - na de verwachte goedkeuring ervan in het parlement - een grootscheepse informatiecampagne wil lanceren om de publieke opinie te winnen voor die misschien nog wat onwennige maar heel reële, nieuwe vorm van ‘medemenselijke solidariteit’, waardoor iemand na zijn dood een orgaan ter beschikking stelt van de lijdende medemens. Men denkt daarbij vooral - hoewel lang niet uitsluitend - aan nieroverplantingen, die de zowel duurder als omslachtiger dialysebehandelingen (aan huis of in het ziekenhuis) zouden kunnen vervangen, tot groot voordeel van de patiënt. Dat er te weinig (geschikte) nieren beschikbaar zijn, wijt men op de eerste plaats aan het ontbreken van een aangepaste wetgeving; en vervolgens aan de falende informatie van de potentiële donors en ontvangers. Het loont dan ook de moeite na te gaan hoe de medische wereld en het publiek op zo'n wetswijziging hèèft gereageerd in de paar landen waar ze reeds werd doorgevoerd. Niet alleen het Franse buurland maar ook Spanje is op dat punt de Belgen vòòr geweest. Onverwacht snel en vlot werd op 27 oktober 1979 de wet over orgaantransplantaties in het Spaanse parlement goedgekeurd, en in maart 1980 in een definitieve tekst vastgelegd. Een jaar later maakten de Spanjaarden een voorlopige balans op van de bereikte resultaten, die op verschillende punten beneden de verwachting waren geblevenGa naar voetnoot1. | |||||||||||||||||||||

Op het punt van de geconstateerde duur van de hersendood verschilt de Spaanse wet sterk van de overal elders gehanteerde norm van 24 uur. Voor de Spaanse wet volstaan 6 uur hersendood om iemands dood te constateren. Tegen die ‘progressieve’ of ‘lakse’ interpretatie is in Spaanse medische kringen al veel verzet gerezen. De artsen vrezen dat het vertrouwen van het publiek geschokt zou kunnen worden. In Groot-Brittannië suggereerde een BBC-programma onlangs dat men het in enkele gevallen niet zo nauw genomen had met de overlijdenscriteria van personen bij wie men een orgaan wenste weg te nemen. Dat had voor gevolg dat heel wat personen, die reeds op schrift hun toestemming als donor - na hun dood - hadden gegeven, hun contract verbroken hebbenGa naar voetnoot2. In dezelfde medische kringen heerst een ernstig voorbehoud ten aanzien van de veronderstelde toestemming van de donor en zijn naastbestaanden. De Spaanse wettekst formuleerde dan ook de aanbeveling: naar geschikte middelen te zoeken om de terminale patiënt-donor en zijn naastbestaanden op de hoogte te brengen van de nieuwe plicht tot solidariteit die de wet met zich mee brengt. | |||||||||||||||||||||
Problemen van en nà de juridische oplossingEen aantal, vaak zeer menselijke problemen bleken door de nieuwe wetgeving niet bevredigend opgelost te zijn. Wij zagen reeds dat de meeste artsen de door de wet gehanteerde vorm van 6 uur hersendood blijven afwijzen. Zij verklaarden in de praktijk te willen vasthouden aan de elders gehanteerde norm van 24 uur. Vervolgens bekenden de artsen dat het | |||||||||||||||||||||

nagenoeg ondoenbaar was gèèn rekening te houden met de uitdrukkelijke toestemming of het eventuele verzet van de naastbestaanden. Sommigen gaven toe aan de ingreep te verzaken wanneer een dergelijk verzet wordt geuit. Zij kwamen er onomwonden voor uit dat de wet het weliswaar voortdurend over ‘overledenen’ heeft, maar dat men in feite en haast uitsluitend de talrijke, veelal jongere en gezonde verkeersslachtoffers op het oog heeft, die als de meest geschikte en overvloedig beschikbare donors beschouwd worden. In de uiterst dramatische omstandigheden van een ongeval met dodelijke afloop, de terminale patiënt of zijn naastbestaanden diets maken dat men de stervende (overledene) een geschikte donor acht en derhalve gebruik wil en zal maken van het wettelijk recht om een orgaan weg te nemen... dat vonden vele artsen tè veel van ze gevergd. Al te licht vergeet men wat een geplande transplantatie met zich mee brengt: om het orgaan in goede staat te bewaren, worden een aantal functies van het dode lichaam (ademhaling, hartslag) kunstmatig aan de gang gehouden, vaak 24 uur langGa naar voetnoot3. Iedereen moet inzien dat, wanneer dit conserveringsproces al ingezet is, de medische diensten in gèèn geval de naastbestaanden nog de ‘laatste troost’ kunnen gunnen van een ultieme groet of bezoek aan hun dierbare afgestorvene. En dat verklaart dan de onverkwikkelijke sfeer van heimelijkheid en halve waarheden waarin die naastbestaanden veelal terechtkomen, wanneer het conserveringsproces volop aan de gang isGa naar voetnoot4. De Spaanse artsen vonden dat men de eerlijkheid en de moed moet hebben om ook dat soort informatie - tijdig - onder het publiek te brengen, zodat er geleidelijk begrip voor - en aanvaarding van - die pijnlijke maar onvermijdelijke nevenaspecten van de weldaden van de transplantatie zou kunnen ontstaan. Die moeilijke opdracht zonder meer doorspelen naar de medische dienst die het stervende of gestorven verkeersslachtoffer herbergt, is tegelijk naïef en on-menselijk en kan onmogelijk de van de wet verhoopte gunstige resultaten afwerpen. | |||||||||||||||||||||
Vrijwillige en onvrijwillige donorsDaarmee werd de bal teruggekaatst naar de informatie- en sensibiliserings-programma's die mikken op het grote publiek. De Spaanse Vereniging voor de Strijd tegen de Nierziekten ALCER (Asociación para la Lucha contra las Enfermedades del Riñón) heeft een campagne gelanceerd, onder het motto: ‘No te los lleves. Dónalos!’. (Neem ze niet mee - in het graf -. Geef ze weg!) Hoe goed ook bedoeld, liet die campagne toch een wrange bijsmaak na. ALCER stelde: ‘Het is tragisch dat in Spanje jaarlijks ongeveer 2.000 mensen aan nierziekten sterven en dat nog eens duizenden fysisch en moreel aan een kunstnier gebonden zijn, terwijl ondertussen ettelijke duizenden dodelijk verongelukten begraven worden met organen die het leven van zovelen hadden kunnen redden of verlichten!’. Alsof het niet eveneens tragisch is dat er in onze hoog ontwikkelde samenlevingen, jaar in jaar uit, duizenden do- | |||||||||||||||||||||

delijke verkeersslachtoffers vallen! De medische instanties, de wetgever en binnen kort wellicht ook nog de publieke opinie schijnen ervan uit te gaan dat die moordende ‘beschavingsziekte’ nog wel voor onbepaalde tijd een statistisch voorzienbare en onvermijdelijke tol aan duizenden doden zal blijven opeisen, die dan als geschikte donors sowie-so toch voorhanden zijn. Men ontkomt moeilijk aan de indruk dat vooral de hoogst ontwikkelde westerse landen weer eens blijk geven van het nuttigheidsdenken dat onze technologische beschaving kenmerkt. De jaarlijks verschijnende rapporten van de European Dialysis and Transplant AssociationGa naar voetnoot5 wezen uit dat het vrijwillig afstaan van een nier door een levende donor veelvuldig voorkomt in de mediterrane landen (en opmerkelijk genoeg ook in Zweden en Noorwegen), terwijl in de resterende, meestal nog welvarender landen van de Associatie de transplantatie ‘tussen levenden’ een uitzonderlijk gering percentage van alle transplantaties uitmaakt. Op een totaal van 2.553 nieroverplantingen, in 1979 in de landen van de Associatie uitgevoerd, werd in 13,9% van de gevallen de nier door een levende donor afgestaan, maar in Spanje b.v. bedroeg de vrijwillige schenking al 24,5% van het nationale totaalGa naar voetnoot6. Wanneer dus een minister of staatssecretaris van Volksgezondheid èn Leefmilieu oproept tot solidariteit met de lijdende medemens, zou men mogen verwachten dat hij ook zijn bezorgdheid uit over de duizenden doden in het verkeer, die hij en het publiek schijnen te beschouwen als een voorgoed verzekerde ‘organenbank’. Enige solidariteit met de onvrijwillige donors van de toekomst en hun naastbestaanden zou niet misplaatst zijn. | |||||||||||||||||||||
Transplantatie en dialyseDaartegenover staat dat nieroverplanting inderdaad veruit de beste en meest menswaardige oplossing is voor de patiënt, zowel wat zijn overlevingskans als de ‘normaliseringskans’ van zijn leven betreft. Op grond van de meer dan 24.000 nieroverplantingen die tot einde 1979 in de landen van de Europese Associatie werden uitgevoerd, konden de respectieve merites vergeleken worden van: Dialyse in het ziekenhuis (DZ) - Dialyse aan huis (DH) - Transplantatie tussen levenden (TL) - Transplantatie van dode donor (TD). De overlevingskans van de patiënt, na 1, 3 en 10 jaar, ziet eruit als volgt:

Uit de tabel blijkt dat de dialyse in het ziekenhuis over de hele lijn de minst efficiënte behandeling is, en dat de transplantatie tussen levenden van meet af aan op de tweede beste plaats komt en op langere termijn de hoogste score haalt. Onder normaliseringskans verstaat men de kans om opnieuw een nagenoeg normaal actief leven te leiden. Na één jaar dialyse (of één jaar na de transplantatie) ziet ze eruit als volgt (in dalende volgorde gerangschikt):
Hier halen beide transplantaties de hoogste cijfers en ligt de dialyse in het ziekenhuis nogmaals ver achterop. Merken wij nog op dat de dialysebehandeling gemiddeld drie sessies per week van telkens vijf uur impliceert, en dat één jaar dialysebehandeling in het ziekenhuis evenveel kost als één nieroverplanting. Uit de studie blijkt dat de transplantatie tussen levenden de ideale oplossing is voor de patiënt, en dat de tweede beste oplossing de dialyse aan huis en/of de transplantatie met de nier van een dode is. De transplantatie tussen levenden veronderstelt vanzelfsprekend een gebaar van solidariteit dat geen enkele wetgever zijn burgers kan opleggenGa naar voetnoot7. | |||||||||||||||||||||
BesluitEen nog zo aangepaste wetgeving lost niet meteen alle problemen op die met de orgaantransplantaties verbonden zijn. De wetswijziging mag in geen geval een aanleiding of een voorwendsel zijn om een van de meest dodelijke ‘beschavingsziekten’ - de dood op de weg - dan maar verder ongemoeid te laten. Zelfs de indruk alleen al dat het die richting uitgaat dient volstrekt vermeden en voorkomen te worden. En de oproep tot solidariteit kan en mag ook verstaan worden als een appèl tot het vrijwillig afstaan van een orgaan, waarvan wetenschappelijk vaststaat dat het veruit de gunstigste oplossing is. Wat is plagiaat?Wie in het zesde deel van de Encyclopoedia Britannica het lemma ‘copyright’ naslaat, kan daar lezen dat de loutere gelijkenis van een tekst met een andere onvoldoende is om een schending van het auteursrecht aan te klagen. Nu komen in de literatuur nogal wat gevallen voor van teksten die erg veel op elkaar gelijken. Pas wanneer het gaat om een wetens en willens ver- | |||||||||||||||||||||

zwijgen van de brontekst spreekt men van plagiaat. In de andere gevallen wordt geoordeeld dat het om onbewuste beïnvloeding of een toevallige, door de auteur niet bedoelde overeenkomst in de verwoording gaat. Het individuele kunstwerk staat immers nooit op zichzelf maar verschijnt altijd tegen de achtergrond van de gehele menselijke cultuur. De Franse auteur en literaire theoreticus Michel Butor heeft dit fenomeen zeer scherp als volgt geformuleerd: ‘Il n'y a pas d'oeuvre individuelle. L'oeuvre d'un individu est une sorte de noeud qui se produit à l'intérieur d'un tissu culturel au sein duquel l'individu se trouve non pas plongé mais apparu. L'individu est, dès l'origine, un moment de ce tissu culturel’Ga naar voetnoot1. Cornets de Groot, die volgens Martien J.G. de Jong als literair criticus en essayist ‘tegenover de reductie van de wetenschap de amplificatie van de intuïtie stelt’Ga naar voetnoot2, heeft in de dertien opstellen van zijn boek Ladders in de leegteGa naar voetnoot3 zijn vaak markante bevindingen neergeschreven over de ‘toeëigening’ door auteurs van andermans teksten en dat in verschillende omvang en op verschillende niveaus. In sommige gevallen gaat het om kerngedachten van buitenlandse auteurs van formaat die in het werk van Nederlandse schrijvers op een eigen manier gestalte hebben gekregen. Zo b.v. Nietzsche in de vroege romans van Harry Mulisch, Rilke in Mulisch' Voer voor psychologen en ook in de poëzie van Lucebert, de troubadourslyriek in de poëzie van Elburg, Goethe in het oeuvre van A.C.W. Staring. In andere gevallen gaat het om frappante hoewel niet systematische overeenkomsten, zoals tussen een sonnet van Vestdijk en een van Jacobus van Looy of tussen W.F. Hermans' essay Machines in bikini en het grafisch werk van de Amerikaanse architect van Roemeense afkomst, Saul Steinberg. In het openingsessay van Ladders in de leegte vermeldt Cornets de Groot een bijzonder en eigenlijk amusant geval van ‘plagiaat’. In 1911 schreef P.H. Van Moerkerken een novelle Jan van der Dom. Toen in 1929 de Utrechtse Domtoren hersteld werd, verscheen het verhaal in een Utrechts blad als een oeroude mondeling overgeleverde legende, waaraan Van Moerkerken de vorm zou hebben gegeven. Terwijl het diens pure eigen fantasie was! Vreemd is daarentegen de vraag die de auteur op p. 54 stelt: ‘waarom duurde het tot '50 eer de roman De vijf roeiers (van S. Vestdijk - J.G.) voltooid werd, tot '51, tot na de dood van Cramer, voor de roman verscheen?’ Die vraag is het gevolg van het vermoeden, ja zelfs de zekerheid van Cornets de Groot dat een vertelling van Hendrik Cramer de stof geleverd heeft voor Vestdijks roman. Nu is Hendrik Cramer, auteur van oorspronkelijk in het Frans geschreven surrealistische verhalen, wegens zijn verzetsactiviteiten in juni '44 door de Duitsers gearresteerd en op 17 december 1944 gestorven in het concentratiekamp Neuengamme. De hele hypothese van Cornets de Groot moet hier wel berusten op een vergissing in de data. Voor een goed begrip van het lange slotessay in vier hoofdstukken, waaraan de titel van de verzamelbundel, Ladders in de leegte, werd ontleend, is de lezer aangewezen op het (her)lezen van Cornets de Groots krimi-essay over de dichtkunst van Lucebert, Met de gnostische lamp (1979), en het in | |||||||||||||||||||||

datzelfde jaar uitgegeven proefschrift van C.W. van de Watering, Met de ogen dicht. Een interpretatie van enkele gedichten van Lucebert als toegang tot diens poëzie en poetica. In een noot bij het vierde hoofdstuk van zijn proefschrift had Van de Watering gezegd dat de door hem geanalyseerde gedichten van Lucebert ook al behandeld waren in diverse artikelen van Cornets de Groot, maar dat hij daarover geen polemiek wou beginnen gezien de nogal erg verschillende methode die beide auteurs gebruiken. C.W. van de Watering doet aan close reading in de striktste zin en steunt zijn interpretatie op een uiterst gedetailleerde taalkundige analyse van Luceberts gedichten. Cornets de Groot daarentegen gebruikt de ‘rotzooi-maar-wat-aan-methode’ die door vele critici en mezelf niettemin gewaardeerd wordt wegens de coherente en vaak verrassende visie die eruit blijkt. Aangezien Van de Watering de discussie niet wou aangaan, besloot Cornets de Groot het zelf te doen en in vier hoofdstukken geeft hij zijn interpretatie van dezelfde vijf gedichten van Lucebert die Van de Watering in zijn proefschrift geanalyseerd heeft. De schimpscheuten op het byzantinisme van de close reading en op de naar de paranoia voerende voorstellen om uit de problemen te geraken bij de interpretatie van Luceberts gedichten zijn niet gering in aantal. Hoewel ik overtuigd ben van Cornets de Groots gelijk, dat bij de interpretatie van Luceberts gedichten uit het begin van de jaren vijftig, zoals de schoonheid van een meisje en ik tracht op poëtische wijze, het verband gelegd moet worden tussen de dichter en de schilder Lucebert, lid van de COBRA-groep, toch ben ik er ook van overtuigd dat Van de Waterings zeer langzaam vorderende analyse/interpretatie-methode nuttig en noodzakelijk (geweest) is in de literatuurwetenschap. De reden daarvoor is haar exactheid en haar poging om een concreet antwoord te geven op de vraag: wat kan een lezer, die toch | |||||||||||||||||||||

maar een klein stukje overziet van het ‘tissu culturel’ waarover Butor het had, aanvangen met zo'n moeilijk toegankelijke poëzie als die van Lucebert? Cornets de Groot heeft trouwens meer dan gelijk als hij schrijft dat het zwoegen van hemzelf en van Van de Watering om een interpretatie te geven aan Luceberts gedichten méér zegt over de noeste arbeider dan over die poëzie. In deze context lijkt me een citaat van Herman De Coninck - uit een gesprek met Willem M. Roggeman in De Vlaamse Gids van vijf jaar geleden - zeer toepasselijk: ‘Hermetische dichters zijn vaak onbegrijpelijk op het eerste gezicht, en maar al te begrijpelijk op het tweede. De taal is een soort koningsmantel die ze om zich heen draperen en waarmee ze mensen op afstand houden, maar eigenlijk is dat vaak een nieuwe-kleren-van-de-keizer-effect’. Wat De Coninck zegt geldt soms ook voor de keizer van de Vijftigers, Lucebert. Het gaat in ieder geval op voor die schrijvers van ‘dieventaal en jargon’, de literatuurwetenschappers, die Karel van het Reve in zijn beruchte Huizinga-lezing (1978) aangepakt heeft en die Jacques Kruithof onlangs in TussenspraakGa naar voetnoot4 zeer voortreffelijk van commentaar voorzien heeft.

Hannah ArendtWanneer Hannah Arendt in 1975 overlijdt, heeft ze enkele van de belangrijkste boeken op haar naam staan die sinds de oorlog op het gebied van de politieke theorie zijn verschenen. Daarbij moet men niet zozeer denken aan verhandelingen over de vraag hoe de staat, het politieke leven e.d. eruit zouden moeten zien (al schreef ze ook dáárover), maar eerder aan analyses van het politieke leven, zoals zich dat in feite afspeelde en afgespeeld had, met name in enkele van zijn meest schokkende vormen: het nazisme en het stalinisme. Toch mag men hier wel degelijk van politieke theorie spreken; de filosofische grondigheid waarmee Hannah Arendt zocht naar de diepste wortels van deze verschijnselen ging veel verder dan die van de loutere beschrijving of het politieke commentaar. Een grondigheid die al naar voren komt in de titel van haar meest bekende en baanbrekende werk op dit gebied: The Origins of Totalitarianism. Filosofie en politiek waren de beide polen waartussen haar leven gespannen stond, maar de filosofie lijkt daarvan toch wel de belangrijkste. Een ‘filosofische biografie’ noemt Elisabeth Young-Bruehl haar omvangrijke en indrukwekkende levensbeschrijving van Hannah Arendt dan ookGa naar voetnoot1. Zij begon als filosofe, studeerde o.a. bij Heidegger en schreef haar eerste boek over Augustinus, en keerde aan het eind van haar leven weer naar haar ‘eerste liefde’ terug, met de onvoltooid gebleven studie The Life of the Mind. Daartussen lagen tientallen jaren van meer of minder publiek schrijverschap over actuele of meer fundamentele politieke onderwerpen. Onbesproken bleef ze daarbij niet. Met name haar verslag van en reflecties op de berechting van de nazi-misdadiger Adolf Eichmann (Eichmann in Jeruzalem) riepen heftige controverses op, vooral vanwege haar kritiek op de zgn. ‘Judenräte’, die zij weinig subtiel van bewuste of onbewus- | |||||||||||||||||||||

te collaboratie met de nazi's beschuldigde. Ook Stephen Whitfield, die in zijn boek Into the Dark, ondanks talrijke punten van kritiek, toch voortdurend van grote bewondering voor Hannah Arendt blijft getuigenGa naar voetnoot2, slaat hier een aanzienlijk scherper toon aan en verwijt haar een ‘excessive hostility to aspects of Jewish conduct’ (231). Het belang van Hannah Arendts boek lag echter ergens anders. In The Origins of Totalitarianism had zij het totalitarisme omschreven als een ‘Novel form of Government’, die een volstrekte breuk betekende ten opzichte van de historisch daaraan voorafgaande staatsvormen, maar ook een breuk binnen de moreel-politieke orde. Een breuk die gekenmerkt werd door het binnentreden van het radicale kwaad binnen de staatsorde: een kwaad dat niets minder beoogt dan de vernietiging van alle menselijkheid als zodanig; een kwaad dat zo monsterlijk is, dat het binnen de bestaande filosofische traditie niet meer kan worden begrepen. Maar tijdens Eichmanns proces realiseerde zij zich dat datzelfde monsterlijke kwaad werd toegebracht door mensen die op zich weinig monsterlijks leken te hebben; geen sadisten of geperverteerden, maar ambtenaren-in-uniform, die deden wat hen werd opgedragen, óók als dat de grootste misdaad betekende die de moderne tijd heeft gekend. Het was deze verontrustende alledaagsheid in de wijze waarop het radicale kwaad ten uitvoer werd gelegd, die door Arendt werd aangeduid met de sindsdien geijkte term ‘the banality of evil’. Het was geen perversie die Eichmann ertoe bracht zijn bevelen zonder aarzelen uit te voeren; het was gedachtenloosheid, de opschorting van elke reflectie en, daardoor, van elk zelfstandig oordeel. En het was die gedachtenloosheid die het totalitarisme het instrument gaf tot het uitoefenen van de terreur die haar voornaamste kenmerk én levensvoorwaarde was. De samenhang van denken, willen en oordelen had het onderwerp moeten worden van The Life of the Mind. Twee delen verschenen slechts (Thinking, Willing), aan het laatste deel (Judging) is Hannah Arendt niet meer toegekomen. Maar al in het eerste deel, dat nu ook in het Nederlands is vertaaldGa naar voetnoot3, wordt al veel van die samenhang duidelijk. Het denken, zoals Arendt dat verstaat, is een breuk met het direct beleefde en het concrete; het trekt zich terug uit de wereld en schept een afstand daartoe. In die afstand speelt zich de reflectie af, maar daarin komt ook het oordeel (het esthetische, maar ook het morele oordeel) tot stand. Het oordeel is geen resultaat van het denken, maar een afgeleide. Het is, zegt Arendt, ‘het bijprodukt van de bevrijdende werking van het denken’ en tegelijk ‘realiseert het het denken zelf en maakt het het manifest in de fenomenale wereld’ (216). De exacte verhouding tussen denken, willen en oordelen blijft in dit deel nog duister, ondanks alle aanzetten tot een samenhangende visie. Hannah Arendt heeft die samenhang niet meer kunnen voltooien. scendentie van de geest, in het denken dat onaantastbaar is omdat het zich buiten de wereld af speelt. Het lijkt een nogal idealistische positie, tegenover het mateloos geweld dat het radicale kwaad ten toon spreidt. Misschien heeft Hannah Arendt ook wel wat getwijfeld aan de effectiviteit van haar wel zeer filosofische antwoord. En misschien vandaar ook de wat relativeren de toon, wanneer ze tegen het einde van het boek zegt: ‘De manifestatie van de wind van het denken is niet kennis, maar het vermogen om goed van slecht en mooi van lelijk te onderscheiden. En misschien kan dit werkelijk op de zeldzame ogenblikken dat de teerling geworpen is, rampen voorkomen, althans voor het zelf’ (216). |
