Brieven van en aan Jacob Israël de Haan 1899-1908

De Haan aan Verwey, 4 januari 1907 (volgens poststempel)Zeer waarde heer Verwey, in het Groene Weekblad van 29 December had ik een stukje geschreven over de zaak De Geer-De Montigny. Tegen dat artikeltje zal de volgende week een stuk verschijnen van Dr C. Weynaendts Francken, waaronder de heer De Koo mij verzocht een bijschrift te zetten. Voor dat bijschrift is 't mij van belang te weten of mijn artikel: ‘Macht en Recht’ in ‘De Beweging’ komt. De twee onderwerpen raken elkaar van dichtebij, en ik zou dan gemaks- en duidelijkheidshalve naar ‘de Beweging’ kunnen verwijzen. Wilt U mij even schrijven? Maar niet, als ge veel te doen hebt. Dan noem ik 't artikel niet, en maak mijn onderschrift maar wat uitvoeriger. Dat het U welga. Geheel d'Uwe Jacob Israël de Haan
Het stuk van Wijnaendts Francken, gedateerd 30 december 1906, draagt als titel: ‘Een zonderling standpunt’. De schrijver vindt De Haans ideeën ‘meer stout dan juist’. De misdadiger moet gestraft, ook al ‘moge [het] niet aangenaam zijn voor een volle zaal als beklaagde te verschijnen, vooral niet wanneer men behoort tot kringen als waarvan hier sprake is’. In zijn antwoord betoogt De Haan dat men bij het bepalen van een strafmaat toch meer zou moeten letten op de maatschappelijke gevolgen van een en ander voor de veroordeelde. Voor de achtergrond van zijn denkbeelden over recht en macht verwijst De Haan naar de ‘intree-rede’ van ‘professor meester’ Struycken. Diens uiteenzetting van de ‘regelen des rechts’ is ‘voortreffelijk’. ‘Allicht, dat ik hier 't zij elders gelegenheid vinde op deze vragen des rechts terug te komen’. Waarschijnlijk wist hij toen al wel dat zijn opstel ‘Macht en recht’ niet in De Beweging zou verschijnen. In het satirisch weekblad De Ware Jacob werd De Haan op 26 januari 1907 flink te grazen genomen. Het blad publiceerde een zogenaamde ‘intieme brief’ van Jonkheer de Geer, geschreven vanuit zijn cel. De jonkheer klaagt zijn nood en richt zich daarop diep getroffen tot De Haan: ‘het is een schande, het is een publiek schandaal, dat een man als ik veroordeeld is tot 4½ jaar cel. Ik ben totaal onschuldig; ik ben al genoeg gestraft met het verlies mijner maatschappelijke betrekking en het is goed, dat er éen ridder is geweest, die het zwaard voor me heeft opgenomen: de Heer Jacob Israël Pijpelijn in de Groene van Ouwejaar. Deze man komt tot de konklusie, dat eén dag de zwaarste eisch mag wezen voor mijn nalatigheid. [...] O, kom, Jacob Israël, kom in mijn cel, ik zal u in mijn oude armen nemen en u kussen, kùssen, want ik ben tot in het diepste mijner ziele geroerd door uwe edelmoedige verdediging. Kom!’. In dezelfde aflevering van De Ware Jacob wordt een voordracht van Aletrino behandeld, in de januari-aflevering van De XXe Eeuw onder de titel ‘Wat de crimineele anthropologie ons leert’ gepubliceerd. Daarbij wordt ‘goede’ Aletrino, ‘zooals de pijpelijntjestrekker Jacob de Haan hem noemt’, opnieuw met ‘Sam uit de “Pijpelijntjes”’ in verband gebracht, eigenaardig genoeg, want daaruit blijkt dat in 1907 althans bij De Ware Jacob nog steeds de eerste, opgekochte en vernietigde versie van de roman bekend was en ook bij de lezer bekend werd verondersteld en niet de tweede, omgewerkte versie, waarin ‘Sam’ immers in ‘Hans’ is veranderd en die ook niet meer ‘aan goede A. Aletrino’ was opgedragen. Er komt in 1907 een ware golf van publicaties van Jacob Israël de Haan los. Er had zich dan ook in 1906, kan men zeggen, een soort stuwmeer gevormd. In het tijdschrift Levensrecht581. begon De Haan een serie ‘Kleine beschrijvingen’, met het verhaal ‘Het daggie’. Het is een verhaal in de trant van ‘Kleedkloppen’, dat in augustus 1906 in Ontwaking stond, en een relatie met Pijpelijntjes is gemakkelijk aan te wijzen. De hoofdfiguur, juffrouw Veer, organiseert een bootreisje naar Zaandam, voor haar buurvrouwen, onder wie juffrouw Bergman die op ‘zeven-en-twintig in het huis’ woont, en juffrouw Assmann (die ook in ‘Kleedkloppen’ voorkwam) en ‘de nieuwe juffrouw van drie-en-dertig twéé-hoog’: we bevinden ons dus wèl in de buurt van 29 St. Willibrordstraat en zelfs juffrouw Mens (in Pijpelijntjes eerste versie: Meks) wordt meegevraagd, hoewel haar man had gezeten en ‘dat was een smet, die was en bleef’. Het doel van het uitstapje, Zaandam, is aantrekkelijk: ‘Allemaal slooten en zoo, en houten huizen, die waren dan groen geverfd’. Maar de organisatie geeft haken en ogen: wie zorgt er bijvoorbeeld voor de boterhammen? Juffrouw Veer wordt ‘ziek van woede’ en loopt ‘den heelen dag met 'n natte doek met azijn om haar hoofd’. Van het uitstapje zelf vertelt De Haan ons niets. Ook zou hij het voorlopig bij deze ene ‘kleine beschrijving’ laten. Maar tegelijk liep in het tijdschrift Ontwaking het eerste deel van de nieuwe roman Ondergangen van stapel. De publicatie van deze roman, in zes afleveringen, zou de gehele eerste helft van 1907 voortduren. In Levensrecht kwam in de februari-aflevering582. redacteur Johan Schmidt nog eens op Pijpelijntjes terug: ‘Zelden ben ik heviger getroffen geworden door een beschrijving, als Pijpelijntjes mij vermocht te doen. O, nog grooter dan de literaire beteekenis van dit boek is de pathologische. Daarom houd ik 'r ook zoo bizonder van. 'k Heb 't bewonderd. Ik waardeer 't. Want hier heeft Jacob de Haan 'n onderwerp behandeld, dat zeer zeker buitengewoon, ontzaggelik van omvang is. Hij heeft 'n wonde blootgelegd. Hij heeft zonder te moraliseeren plots 'n brok leven hel belicht’. Na een uitweiding over de maatschappij en het ‘dilemma’ waar Pijpelijntjes ons mee confronteert, bewondert Schmidt onderwerp en aanpak van Pijpelijntjes en vooral ook de dialogen en de psychologie: ‘'n man met oogen en ooren is hier aan 't werk gegaan, één, die niet met zijn hart te koop loopt en niet kermt om den dood, terwijl ie aan 'n lekker diner denkt. Waarachtig, we hebben hier een merkwaardige persoonlikheid ontmoet, die nog veel van zich zal doen spreken omdat-ie véél kan en is. Ik hoef er niet bij te voegen dat hij daarom al op nominatie staat om vooreerst afgemaakt te worden. Maar ondanks al 't geschetter zal eenmaal blijken dat we Jacob de Haan dank verschuldigd moeten zijn! En wel in de eerste plaats om zijn moed, dit gegeven tot een boek te durven maken’. Waarschijnlijk heeft iemand de moed van Johan Schmidt willen testen om een verhaal over een dergelijk précair onderwerp in zijn eigen tijdschrift te durven plaatsen. In de correspondentierubriek van het blad, p. 200, vinden we de volgende tekst: ‘Alb. de W. - te waar? Uw adres hebt u veiligheidshalve verzwegen? Uw schets durfde ik best plaatsen, als zij literair was. Zooals ze nu is, komt ze meer voor een ordentelik geschreven brief in aanmerking. Ik zie dat velen op mijn kritiek over Pijpelijntjes aanvliegen. Nu u alweer met een bijdrage. Meen nu toch niet dat uw schets iets bewijst. Dat doet Pijpelijntjes en daarom schreef ik er zoo gunstig over. Wat u me toezond is niets dan een opsomming van wat een nachtlooper doet, die juist daardoor heel goed enkel tijdelik pervers kon zijn. 't Tegendeel bewijst u niet. Analyseering van het innerlike van de tegen-natuurlike drang, van de psychische behoefte, ho maar - enkel lichamelik begeeren, pervers en genietingszot. Dank u’. Vermelding verdient nog de satanistische foto van Jacob Israël de Haan, die Schmidts Pijpelijntjes-kritiek opluistert. Het is de foto die in 1908 in Pathologieën zou worden opgenomen583.. In Ontwaking publiceerde De Haan twee wetenschappelijke beschouwingen. In februari (p. 81/7) besprak hij de oratie van de Groningse hoogleraar in het strafrecht, J. Simon van der Aa, getiteld: De arbeid als element van de vrijheidsstraf. De rede was volgens De Haan ‘voortreffelijk van feilloozen inhoud’, maar ‘handwerk’, niet ‘het ruime kunstwerk, dat professor meester G.A. van Hamel van ieder zijner rechtskundige studiën maakte’. Van der Aa kwam niet toe aan de wezenlijke vragen van het strafrecht. Verwacht men van straf vergelding of een afschrikkende werking, dan zal men de arbeid voor de gevangene onaangenaam maken: ‘Weet men het nog hoe de uitmuntende Oscar Wilde in de Engelsche tredmolen liep te martelen?’. Van der Aa stelt hem teleur: ‘Ik wil de schoonheid in de wetenschap. De dadelijke ontroering, en die vind ik niet’. In een volgende aflevering (p. 158/62) besprak hij Aletrino's geschrift Is celstraf nog langer geoorloofd en gewenscht? Deze vraag is ‘geen beginselvraag’, aldus De Haan, ‘en dat maakt haar dadelijk tweederangs’. Maar Aletrino's boek is ‘leesbaar zonder fouten’ en ‘zeer goed voldoend gedocumenteerd’584.. Een derde wetenschappelijk opstel van De Haan verscheen in Levensrecht (p. 342/7) en wel zijn stuk ‘Macht en recht’ over Struyckens oratie Positief recht, in het oordeel van De Haan een ‘heerlijk geschrift’, waar hij toch heel wat op aan te merken heeft. Het komt erop neer dat de vraag: ‘bestaat er recht zonder macht, en macht zonder recht?’ - bijvoorbeeld: schept Engeland in Transvaal ‘geldend recht’? - door Struycken met ja en door De Haan met nee beantwoord zou worden: ‘Engeland's macht in de Transvaal [is] geen geldend recht, maar die is wel geldige macht en machtig onrecht’. Ook treffen we in dit opstel ‘Macht en recht’ weer een boutade aan (‘Van problemen houd ik, maar 'k meende te weten, dat zij nooit konden worden opgelost’) die ongeveer de gedaante van een aforisme aanneemt, van een besliste volzin zoals De Haan die noemt. In maart 1907 plaatsen wij een brief van De Haan aan Van Deyssel: hij moet geschreven zijn vóór De Haans huwelijk, want het is onwaarschijnlijk dat De Haan, hoewel getrouwd met iemand uit de Palestrinastraat, zelf toch in de St. Willibrordusstraat was blijven wonen. |
